Welcome, and thank you for using golpodadu (which includes the website www.golpodadu.com and the Android app). golpodadu is operated by TwoPiRadian Infotech Private Limited.

By using golpodadu, you are agreeing to the following Terms of Use. Please take a few minutes to read and understand the document. This agreement applies to all users of golpodadu, whether registered or unregistered.

If you are a parent or a legal guardian and you provide consent for your child to use golpodadu, you agree to these terms in respect to your child’s use of golpodadu.

If you do not agree to the Terms of Use, please do NOT use golpodadu and exit golpodadu / uninstall the Android app immediately.

Purpose

golpodadu intends to revive the lost art of storytelling and restore some of the iconic but often-forgotten stories to the rich tapestry of our vernacular heritage. We have developed a repository of childhood stories, initially in the Bengali language, from some of the most renowned authors of yesteryears. Our mission is to a build a repository of stories for children, in the form of storytelling sessions. Each story would have a rich use of images, created specifically for that story.

Use of Services

Unless otherwise stated, golpodadu exclusively owns the intellectual property rights or the license to use the content of golpodadu including, without limitation, texts, images, audio and video contents, graphical interface and source code. Using golpodadu does not give you ownership of any intellectual property rights of the content you access. The content of golpodadu is available for personal, non-commercial use only and the content is protected by Indian and international copyright laws and other applicable laws governing intellectual property rights. You must not use the content of golpodadu for any commercial advantage unless you obtain written permission from golpodadu. You must not download, distribute, sell, lease or modify any content from golpodadu.

golpodadu is available for use by any account, provided

• 1) the account is not already restricted to use golpodadu and
• 2) the usage is in compliance with all applicable laws and regulations.

Membership / Account

You may need an account in order to use some features of golpodadu. You agree that the information you provide at the time of registering will be true, accurate and complete. You must ensure that the account credentials are kept confidential. You are responsible for all the activities that happen using your account unless you report any unauthorised use of your account ID or password. You may be liable for the losses incurred by golpodadu or others due to any unauthorised use of your account.

golpodadu has the rights to disable your account credentials at golpodadu’s sole discretion without notice or explanation, if any terms are violated.

If you have an account of golpodadu and are under the age of 13, you may not register an account for golpodadu without consent and approval from your legal parent or guardian.

User Content

In these Terms of Use, “content” means posts (including, without limitation, text, images, audio or links) that you submit to golpodadu.

When you submit content to golpodadu, you grant golpodadu a worldwide, perpetual, irrevocable, non-exclusive, royalty-free license to use, store, reproduce, modify, publish, display, translate and distribute your content in any existing or future media. This continues even if you stop using golpodadu.

You are solely responsible for your content and any consequences of posting them. You represent and warrant that your content:

• Must not be illegal or unlawful, and must not be capable of giving rise to legal action whether against you or golpodadu or a third party (under any applicable law)
• Will not be inappropriate, offensive, indecent or objectionable
• Will not infringe, violate or misappropriate any third-party right including, without limitation, copyright, privacy right, right of publicity or intellectual property right
• Will not contain any virus, spyware or other malicious code

golpodadu reserves the right to review the content before publishing and may refuse to display the content that golpodadu reasonably believes to be inappropriate. golpodadu is not obligated to publish all posts and can remove posts in golpodadu’s sole discretion, without notice. Whether or not such content is published, golpodadu does not guarantee any confidentiality with respect to any submissions.

Although golpodadu will take every measure to block content that is inappropriate, offensive, indecent or objectionable, you may be exposed to such content. golpodadu does not endorse any opinion, recommendation or advice expressed therein, and golpodadu expressly disclaims any and all liability in connection with such content.

If you submit feedback or suggestions about golpodadu, golpodadu may use your feedback or suggestions without obligation to you.

DOs and DON’Ts

You agree that you will comply with all applicable laws, provide accurate information and adhere to the Terms of Use.

You also agree that you will not

• Create a false identity or use another person’s profile or access the services except through the interfaces provided by golpodadu
• Post inappropriate, offensive or objectionable content or any content that is illegal or unlawful, and is capable of giving rise to legal action whether against you or golpodadu or a third party (under any applicable law)
• Defame, harass, abuse or threat golpodadu and its partners (the professionals that golpodadu works with to provide the service) or other users of golpodadu
• Post anything that contains any virus, spyware or other malicious code
• Infringe, violate or misappropriate any third-party right including, without limitation, copyright, privacy right, right of publicity or intellectual property right
• Use golpodadu for any commercial purpose without written consent from golpodadu
• Republish material from golpodadu in any form (including republication on another website) or reproduce, duplicate, copy, translate, sublicense, distribute, create derivative work or otherwise exploit material on golpodadu for a commercial purpose
• Cause damage to golpodadu or impair availability or accessibility of golpodadu or interfere with its security features
• Conduct any systematic or automated data collection activities (including, without limitation, copying, scraping, data extraction) on or in relation to golpodadu using technology or manual work
• Reverse engineer, decompile, disassemble or derive the source code for the services or any part thereof
• Use golpodadu to transmit or send unsolicited commercial communications, promotional materials or spam mails
• Use golpodadu for any purposes related to marketing without golpodadu’s written consent.

No Warranties

Golpodadu is provided “as is” without any representations or warranties, stated or implied. golpodadu does not make any specific promises on the reliability and availability of golpodadu or any specific content. golpodadu does not guarantee that golpodadu will function without interruption or errors or will be constantly available or available at all. golpodadu cannot promise to store the content for indefinite period and may remove all or part of content at any time.

golpodadu does not guarantee that the content will be free from any virus or harmful components though golpodadu will take every measure to protect the content from virus, spyware or malicious code. You agree that you will use golpodadu at your own risk and you will be solely responsible for any damage to your computer system or loss of data resulted from the use of golpodadu.

Nothing on golpodadu constitutes, or is meant to constitute, advice of any kind.

Limitations of Liability

To the extent permitted under law, golpodadu and its partners shall not be liable to you in relation to the contents of, or use of, or otherwise in connection with golpodadu for any direct, indirect, incidental, special or consequential loss or for any financial loss, loss of revenue, income or profits, loss of contracts or business relationships, loss of reputation or goodwill, or loss of data. These limitations of liability apply even if golpodadu has been expressly advised of the potential loss.

You agree that you will not bring any claim personally against any of the professionals that golpodadu works with to provide the service in respect of any losses you suffer in connection with golpodadu.

Indemnity

You agree to indemnify and hold harmless golpodadu and its partners from any claims, losses, damages, liabilities and expenses (including without limitation legal expenses) incurred or suffered by golpodadu arising out of any misuse of golpodadu or any breach of terms by you (or any child account for whom you are the legal guardian).

Termination

golpodadu, in its sole discretion, may terminate any account without notice or explanation. golpodadu has the rights to disable your account if any terms are violated. If you breach the Terms of Use in any way, golpodadu may take action as it deems appropriate to deal with the breach, including restricting your access to golpodadu, blocking computers using your IP address from accessing golpodadu and/or bringing court proceedings against you.

On termination, golpodadu may remove all or part of your content and your account profile. You agree that golpodadu will not be liable to you or any third party for such termination. However golpodadu’s right to use and disclose your feedback shall survive termination.

You may terminate your account at any time and discontinue use of golpodadu.

About these Terms

golpodadu reserves the right to revise the terms at any time and the revised Terms of Use will be effective from the date of publication of the revision on golpodadu. Please check the Terms of Use periodically for any changes. If you do not agree to these changes, you must stop using golpodadu.

If a provision of these Terms of Use is determined by any court or other competent authority to be unlawful and/or unenforceable, the same will be deemed to be deleted, and the rest of the provision will continue in effect.

The Terms of Use will be governed by and construed in accordance with the laws of India, and any disputes relating to the Terms of Use will be subject to the exclusive jurisdiction of the courts of Kolkata, India

Disputes arising under the Terms of Use will be resolved in accordance with the version of the Terms of Use in place at the time the dispute arose.

golpodadu may transfer, sub-contract or otherwise deal with golpodadu’s rights and/or obligations under these Terms of Use without notifying you or obtaining your consent. You may not transfer, sub-contract or otherwise deal with your rights and/or obligations under these Terms of Use.
